What is the Can-Spam Act?

The CAN-SPAM Act is a congressional act designed to combat spam attacks on individuals and businesses. Spam emails can cause businesses to lose time, money, and resources. In an effort to protect individuals and businesses, Congress has declared spam emails to be illegal.

A violation of the CAN-SPAM Act can lead to fines of up to $16,000 per violation.

The CAN-SPAM Act targets emails of a commercial nature. Commercial emails are “any electronic mail message the primary purpose of which is the commercial advertisement or promotion of a commercial product or service (including content on an Internet website operated for a commercial purpose).”
